CIPAA claim Malaysia: overview

A CIPAA claim recovers unpaid construction payments under the Construction Industry Payment and Adjudication Act 2012. The basics

What is CIPAA?

CIPAA is the Construction Industry Payment and Adjudication Act 2012. It came into force on 15 April 2014. It gives the construction industry a fast-track way to settle a construction payment dispute in Malaysia, without going straight to court or arbitration.

The process is called adjudication under CIPAA. An independent adjudicator reviews the claim and the response, then decides who owes what. The adjudicator is appointed by agreement, or by the Director of the Asian International Arbitration Centre (AIAC).

A CIPAA decision is binding on an interim basis. It stands unless a court sets it aside, the parties settle in writing, or the dispute is finally decided by arbitration or the court.

CIPAA covers written construction contracts for work carried out in Malaysia. Conditional payment terms such as pay-when-paid and pay-if-paid are void under CIPAA, so they cannot be used to hold back your money.

CIPAA runs on a strict clock, counted in working days. Here is the path from claim to enforcement.

The unpaid party serves a payment claim. It states the amount owed and the basis for it.

Yes. Under section 28, you can apply to the High Court to enforce the decision as if it were a court judgment, which lets you use normal recovery methods.
